Ucando PTY LTD ("we," "our," or "the Company") offers a digital platform that allows users ("you" or "the user") to access various services, including but not limited to the submission of personal information, location data, and interactions with clients. By using the App, you acknowledge and accept the policies and guidelines established in these Terms of Service.

By using the App, you consent to the collection, storage, and use of personal data, including but not limited to your name, contact information, location data, and other personal details. This information may be shared with relevant third parties necessary for the operation of the service, in compliance with applicable data protection laws.

You agree to provide accurate, current, and complete information as requested by the App.
You acknowledge that your location data may be collected to improve services, enhance user experience, or provide location-specific features.

3. Access to Photos and Gallery

As part of using the App, you may be required to provide access to your device's photo gallery or camera for uploading photos or media. By granting access, you allow us to store and process such content as per our privacy policy and in accordance with the services provided through the App. You remain the owner of any photos or media shared through the App, but you grant Ucando PTY LTD a non-exclusive, worldwide license to use, display, and store the content for the purpose of providing services through the App.

4. Payments and Commission Fees

Ucando PTY LTD facilitates payments between users and clients using third-party payment processors, including Stripe. You agree that payments made through the App will be processed through Stripe or other similar platforms as determined by Ucando PTY LTD.
Ucando PTY LTD charges a 7% commission fee on all transactions between clients found on the App. This fee is deducted from the total payment amount and is non-refundable.
In some circumstances, the commission fee may be tax-deductible, but you acknowledge that Ucando PTY LTD does not offer tax or financial advice. You should consult with a tax professional regarding the deductibility of any payments made.
Payments can take up to 2 weeks to process, depending on various factors, including payment verification and processing times from third-party services.

5. Misguided Behavior and Conduct

Ucando PTY LTD maintains a high standard of conduct for its users. Any misguided behavior, including but not limited to fraud, misuse of the platform, harassment, abuse of personal data, or other unlawful conduct, will not be tolerated.

Any user found engaging in such behavior may have their account suspended or permanently banned from the App at the discretion of Ucando PTY LTD.
We reserve the right to report illegal activity to appropriate authorities as required by law.

6. Updates to Policies and Terms

Ucando PTY LTD reserves the right to update, modify, or change these Terms and any associated policies at any time. Updates will be posted on the App, and by continuing to use the App, you agree to the updated terms. These Terms will be reviewed annually, with the next review scheduled for 2026.

7. Disclaimer of Financial Advice

Ucando PTY LTD provides a platform for facilitating transactions and services between users. However, we do not provide financial, tax, or legal advice. Any information provided through the App, including payment processing, commission fees, or tax matters, is intended for general informational purposes only. You should seek professional advice from a qualified expert before making any financial or tax-related decisions.

8. User Responsibilities

You agree to use the App only for lawful purposes and in accordance with the Terms.
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
You agree not to attempt to access any part of the App that you are not authorized to use, nor to engage in any activity that disrupts or damages the functionality of the App.

9. Termination of Account

Ucando PTY LTD reserves the right to suspend or terminate your account at any time, for any reason, including but not limited to a violation of these Terms. Upon termination, your access to the App will be revoked, and any outstanding obligations or payments must be resolved in accordance with the Terms.

10. Limitation of Liability

To the fullest extent permitted by law, Ucando PTY LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or other intangible losses, arising out of or in connection with the use of the App, including but not limited to the actions of other users or third parties.

11. Governing Law

These Terms and any disputes arising from or related to the App shall be governed by the laws of the jurisdiction in which Ucando PTY LTD is registered, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within this jurisdiction.
